"*** DISHONEST TIMESHARE CONTRACTS ****"

Let me preface this by stating we liked our vacation at Royal Solaris Caribe and thought it was a great place to stay for vacation *** BUT**** be forewarned that their timeshare contracts are very deceptive and dishonest.

We bought a timeshare (they call it vacation club membership) on our last trip down there in April and have been fighting with them ever since to get our money back. They will not honor the contract despite our paying in full for a timeshare membership. They claim that vacation club timeshare memberships do not guarantee anything more than a regular hotel room, despite our contract stating specifically that we are contracted for a studio club member suite.

We found this out when we got home and attempted to book our next vacation down there by using the contracted week of the timeshare for the first time. They sent us confirmation for 2 regular hotel rooms. At first we thought this was a simple misunderstanding and wrote back to them to remind them we are members trying to use one of our timeshare weeks. Turns out it was no misunderstanding on their part and they will not honor the contract for a suite unless space is available after we get there. This is absolutely not what the contract states.

We have all documentation of correspondence with them and are currently fighting through our credit card company for reimbursement. We split the payment, one part has already been refunded back to our card, and we are waiting for the remainder of the payment to be arbitrated.

I'm writing this as a warning to anyone lured into their timeshare presentations. Although the contract appears concrete in verbiage, Mexico does not recognize noncitizen property ownership and as such, the contract is nonbinding on their part because we have no legal recourse as non citizens. I'm not kidding, if you're thinking of a timeshare anyplace down there, read up on this before going.

Thank God we attempted to book our timeshare week immediately, so that we had time to dispute the charges to our credit card within the 60 day of billing timeframe. We can book 2 hotel rooms here for less money than the timeshare and can get free airport transfers also, which the timeshare does not provide.

Feel free to email me if you'd like to see copies of the absurd correspondence we've received from them, with a different story on every single response as to why they cannot provide the contracted services.

I Hope Club Solaris reads this and decides to clean up their act. They charge a lot for the timeshare units, we would have loved to remain members if they would honor the letter of the contracts they write.
